Sample/Draft Language for Offer

(The Buyer's Agent respectfully declines the seller's agent offered co-brokerage fee.) All parties agree that included in the price being offered is a commission of X to be paid to Compass for its services as Exclusive Buyer's Agent. Such fee shall be paid directly from the proceeds of the sale.


Mutual Termination Clause (WITH PROTECTION FOR PROPERTIES SHOWN)

Either party may terminate the Agreement upon 1 day prior written notice to the other party. Notwithstanding the foregoing, any properties introduced and/or shown to the Buyers up until the termination date of the Agreement are subject to the terms of the Agreement.


SPECIFIC PROPERTIES CLAUSE

This Agreement shall only apply to the properties listed below. Broker shall have no duty to assist Buyer in identifying other properties of potential interest to Buyer, and Buyer shall have no obligation to compensate Broker for services related to the purchase of any property not listed below.

This Agreement shall only apply to the cities/towns listed below. Broker shall have no duty to assist Buyer in identifying properties of potential interest to Buyer in other areas, and Buyer shall have no obligation to compensate Broker for services related to the purchase of any property outside of the areas listed below.

If Buyer's lender prohibits Buyer from paying a Commission that exceeds the amount of the Cooperating Compensation offered in MLS, then the Commission due from the Buyer will be reduced to match the amount offered in MLS.

COMMISSION EXCEPTION CLAUSE FOR VA/FHA


Broker has agreed to refer Buyer to [Agent Name of Outside Brokerage Name] to assist with Buyer’s search in the following area: ________________________. If the Buyer purchases a Property in this area during the Term, Buyer will not owe COMPASS a Commission.
